1. Agreement Scope and Services
Welcome to NodeFlowing. By subscribing to our service, you agree to these terms. NodeFlowing provides private, managed Virtual Private Servers (VPS) infrastructure specifically optimized for Graphisoft's BIMcloud. We handle the server provisioning, security configuration, and automated daily backups.Licensing: Servers are deployed with BIMcloud Basic (Free License) by default. Clients wishing to use BIMcloud Professional features must log in with their own valid Graphisoft ID. NodeFlowing does not sell or lease Graphisoft software licenses.2. Price, Payment, and Refund Policy
Subscriptions are billed monthly via our authorized Merchant of Record. The specific Merchant for your transaction will be clearly identified on your checkout screen and receipt.7-Day Money-Back Guarantee: All new subscriptions include a 7-Day Money-Back Guarantee. If you are not satisfied with the server's performance within the first 7 days of activation, you may request a full refund by contacting [email protected].Cancellations: Following the 7-day period, payments are non-refundable. You may cancel your subscription at any time to prevent future billing.3. Fair Use and Customer Obligations
Your license to use NodeFlowing is based on the Plan you selected. You agree to:Respect User Limits: Not exceed the maximum number of concurrent users allowed by your plan (e.g., 6 users for Studio Plan, 10 users for Agency Plan).Maintain Archicad Hygiene: NodeFlowing servers are optimized for standard architectural workflows. The Client is responsible for maintaining optimized project files. Abusing server resources by uploading massive, unoptimized embedded libraries (such as raw 3D Warehouse/SketchUp models) that result in server instability is a violation of fair use.4. Data Ownership and Backups
You retain full control and ownership over your own data and Archicad files. NodeFlowing provides automated daily server snapshots as a safety net. However, the Client is ultimately responsible for their own in-app Archicad data management. NodeFlowing is not liable for data lost due to user error, accidental file overwriting by your team members, or failure to properly save within the Archicad application.5. Limitation of Liability
In the B2B sector, NodeFlowing limits its liability. NodeFlowing shall not be liable for any indirect damages, including lost profits, missed deadlines, or business interruption arising from the use or inability to use the service. We provide the infrastructure (IaaS); the software license (Graphisoft Archicad/BIMcloud) and its functionality are the sole responsibility of the client.6. Termination and Data Retention
You may cancel your subscription at any time. Your server will remain active and fully accessible until the end of your current billing cycle.Grace Period: Upon expiration or cancellation, your server will enter a "Suspended" state for a 7-day grace period. You may request a reactivation or file retrieval during this time.Permanent Deletion: After the 7-day grace period, the server and all associated project data will be permanently deleted from our infrastructure and cannot be recovered.

As a B2B service, we collect only the information strictly necessary to provide your studio with secure cloud infrastructure. This includes:
Business Contact Information: Name, job title, studio name, and professional email address.
Billing Information: We do not store credit card details. All financial transactions are processed securely through our authorized Merchant of Record.
Technical Data: IP addresses used specifically to whitelist access to your private server and secure your connection.2. How and Why We Use Your Data
We use your data strictly for service delivery, infrastructure provisioning, and customer support.
Service Provisioning: To deploy your Virtual Private Server (VPS) and configure your BIMcloud instance.
No Access to Proprietary Data: We strictly do not open, view, analyze, or claim ownership of your proprietary architectural data or Archicad project files (.pln / .pla). Your intellectual property remains 100% yours.3. Data Sharing and Third Parties
We do not sell, trade, or rent your personal data to others. We share necessary data only with trusted infrastructure partners required to operate our service:
Cloud Infrastructure: We utilize enterprise-grade data centers (e.g., Contabo) to host your physical server instance.
Merchant of Record: A third-party reseller handles all billing compliance, tax calculation, and invoicing on our behalf.4. Data Security
We implement industry-standard security measures to protect your data, including:
Role-Based Access Control: Strict internal protocols limiting who can access server management tools.
Network Security: Custom firewall rules that restrict traffic solely to necessary BIMcloud ports, blocking unauthorized external access.5. Data Retention and Your Rights
Active Accounts: We retain your account data as long as you maintain an active subscription.
Deleted Accounts: Upon cancellation, your server data is held in a "suspended" state for a 7-day grace period for retrieval, after which it is permanently sanitized and deleted from our infrastructure.
